There is hereby established a board to be known as the Protection
of

PART V PAYMENT FROM THE FUND

Subject to this Part, an applicant to whom--

Payment
Subject to subsections (1B) and (2) where it appears

Review by Board
Any applicant aggrieved by any decision of the Commissioner
under
ion 16 may in writing--
request the Commissioner to give reasons for that decision; and
after being given reasons under paragraph (a),
request the
issioner to refer the application to the Board.
Upon receiving a request from an applicant under subsection (1)
(b),
Commissioner shall forward all documents relating to the
application

The Board may confirm or vary any decision of the Commissioner
on an
ication referred to it under this section or may for those
purposes
ire the Commissioner to make further inquiries relating
to the

Additional power of Commissioner
Notwithstanding that in any particular case a petition referred
to in
ion 16 (1) (a) (i) or (b) has not been presented against an
employer,
Commissioner may, subject to subsection (2) of that section,
make an
ratia payment under that section in that case if in his opinion--

the employer employs less than 20 employees;
sufficient evidence exists to support the presentation of a

if the employer is a company, that he is unable to pay his debts;

Where the Commissioner exercises his discretion under
subsection (1)

in his

Nothing in subsection (2) shall require the Commissioner to give

Verification of application
For the purpose of verifying any application under section 15,
or if

(1994年1月29日深圳市人民政府令第21号修订发布 根据1999年1月26日深圳市人民政府令第82号《深圳市人民政府关于清理〈深圳经济特区金银市场管理暂行规定〉等18项规章的决定》进行修正)
第一章 总 则
第一条 为妥善处理城市建设中房屋拆迁补偿安置问题,保障城市建设顺利进行,根据国家有关法律、法规和国务院《城市房屋拆迁管理条例》,结合深圳经济特区实际情况,制定本办法。
第二条 凡市、区国土管理部门(以下统称国土管理部门)因征用土地、收回土地或其他用地单位征用土地,涉及拆除土地上的房屋而引起的拆迁、补偿、安置事宜的,适用本办法。
第三条 深圳市规划国土局(以下简称市规划国土局)对全市的房屋拆迁工作进行管理、协调和监督。
区国土管理部门负责组织实施本辖区范围内的房屋拆迁工作,接受市国土局的业务指导和监督。
第四条 国土管理部门拆除被收回、被征用土地上的房屋时应遵循在城市规划的指导下,统筹安排、依法进行、合理补偿、妥善安置的原则。
第五条 任何单位和个人必须服从国家建设需要,不得妨碍和阻挠征用拆迁工作的进行。
第六条 拆迁补偿应协商解决,协商不能解决的,由国土管理部门依法作出征用或收回土地补偿安置处理决定。自决定书发出之日起,土地的权属转为国有或被收回。
第二章 拆除管理
第七条 拆除房屋应经国土管理部门批准并领取《拆除房屋许可证》。未经批准许可的,任何单位或个人均不得擅自拆除房屋。
第八条 属国土管理部门征用或收回土地的,由所在地的区国土管理部门将实施方案报市规划国土局,由市规划国土局同意后发给《拆除房屋许可证》。区国土管理部门领取《拆除房屋许可证》后向业主发出拆除房屋通知书。
南油、蛇口、华侨城、盐田港、沙头角保税区、福田保税区规划范围内的房屋拆除,由用地单位向所在区的国土管理部门领取《拆除房屋许可证》并自行组织实施。必要时,国土管理部门也可以将特殊用地范围内的房屋拆除,指定使用该宗土地的单位或其他单位组织实施。
第九条 由用地单位组织实施拆除工作的,用地单位应提交下列文件、资料,向所在区国土管理部门申领《拆除房屋许可证》。
(一)拟拆除房屋的业主姓名、家庭人口及产权部门提供的产权资料;
(二)拟拆除房屋所在地段、面积、结构、用途及价值;
(三)拟补偿安置方案,包括:补偿金额、安置面积、地点和临时安置计划。
第十条 经区国土管理部门审查,认为用地单位提供的资料真实、补偿方案合理、安置措施妥善的,发给《拆除房屋许可证》,并向业主发出拆除房屋通告书。国土管理部门应将有关拆除事项在《深圳特区报》公告或以其它形式予以公布。
第十一条 业主应自接到拆除房屋通知书之日起三个月内与区国土管理部门或用地单位进行协商,并签订补偿安置协议。法律、法规有特殊规定的,按规定执行。
有关补偿应按本办法和本办法附件规定的标准执行。没有规定标准的,由国土管理部门委托市物业估价所进行评估。本办法附件规定标准的调整,由市建设主管部门公布。
第十二条 协商期限届满后仍不能达成协议的,由区国土管理部门作出征用或收回土地补偿安置处理决定,自处理决定发出之日起,土地原属农村集体所有的,被征为国有;土地使用权原属单位或个人拥有的,被政府收回。业主对补偿安置有异议的,可在接到处理决定书之日起三十日
内向所在区人民法院起诉。诉讼期间不停止拆迁的执行。
业主或使用人必须在处理决定限定期间内自行搬迁。期限届满仍未搬迁的,由市、区人民政府责令有关部门强制拆迁,或由所在地国土管理部门向人民法院申请强制执行。
业主不起诉,在规定期限内又不来领取补偿费的,该补偿费由国土管理部门无息保管。
业主在规定期限内不来认领房屋产权的,该房屋由房管部门代管。
第十三条 业主自接到国土管理部门拆除房屋通知之日起,不得为下列行为:
(一)对被通知拆除的房屋进行改建、扩建和装修;
(二)对被通知拆除的房屋进行买卖、交换、抵押;
(三)对被通知拆除的房屋设立或变更租赁关系。
第十四条 被通知拆除的房屋所在地的居民委员会或村民委员会、公安机关以及业主所在单位,有责任协助、配合国土管理部门和用地单位做好拆迁工作。
第十五条 国土管理部门应当建立、健全拆迁档案制度,加强对拆迁档案资料的管理。
第三章 补偿和安置
第十六条 拆除房屋,根据不同情况进行补偿:
(一)拆除属于城市居民的房屋,补偿同等面积的房屋,但经业主同意,也可以现金补偿。如该地属有偿受让用地(即由市区国土局有偿出让用地,下同)补偿双方必须对地价的差价进行结算。
(二)农村村民在农村用地规划范围内已安排有宅基地的,对其被征用的旧居屋,只给予补偿现金,不再划地,也不再补偿房屋。
(三)拆除华侨和港、澳、台同胞本人在农村的旧屋,可以房屋进行补偿,经业主同意也可以现金补偿。业主在农村规划用地范围内已安排有宅基地的,以现金进行补偿。
(四)拆除单位(含集体、国营企事业单位、机关、团体,中外合资、合作企业,外资企业等)房屋,以同等结构、同等面积进行补偿;该用地属有偿受让的,补偿双方必须就地价(现值)的差价进行结算。经补偿双方商定,也可以换地的方式进行安置。
按本条规定用房屋进行补偿的,以统建形式进行安置,补偿双方应对面积、结构、质量的差异进行差价结算,并在协议中订明。
协商期限届满仍不能达成协议,由区国土管理部门作出处理决定的,对房屋拆迁安置补偿,一般以现金进行补偿。
第十七条 拆迁补偿实行产权调换的,如补回的房屋与原房屋质量或面积相差校大的,补偿双方应进行质量、面积的差价结算。补偿的面积大于被拆房屋面积的,超出部分按微利商品房价格由业主补偿给用地单位。
第十八条 被征用土地拟建房屋与被拆除房屋的用途相同的,业主应当获得就地安置。
第十九条 因公产住房被拆除而受影响的使用人,由市住宅局按有关房管规定给予安置。
第二十条 拆除经批准的临时用地的房屋,原临时用地合同自动终止。合同存续期仍有一年以上的,应对房屋作适当的补偿,但临时用地合同另有规定的,按合同规定办理。
第二十一条 对应当补偿房屋而暂时又无法补偿的,应对受影响的业主和使用人妥善、合理地给予安置临时居所,由此产生的费用由用地单位支付。
第二十二条 因动迁而产生的搬迁费用,由用地单位按实际支出支付给业主或使用人。
业主和使用人所在单位应给予必要的搬迁时间。搬迁期间的工资应予照发。
第二十三条 被拆除房屋原有租赁关系,被拆除后又补偿房屋的,租赁合同继续生效,租赁双方可对有关权利义务进行协商变更;用现金补偿的,租赁合同自动终止。
第二十四条 拆除有产权纠纷房屋,在拆除房屋协商补偿期限内纠纷未解决的,拆迁前,国土管理部门应当组织拆迁人及邀请市物业估价所对将被拆除的房屋作勘察纪录,并向公证机关办理证据保全。
第二十五条 被拆除房屋属下列情况之一的,不予补偿:
(一)违章建筑的房屋;
(二)违法占地上的房屋;
(三)违反土地使用合同,被市国土局收回土地使用权,被收回的土地上的房屋;
(四)违反本办法第十三条第(一)项规定的改建、扩建和装修部分;
(五)土地使用年期届满的房屋。
第二十六条 拆除非住宅房屋造成停产、停业引起经济损失的,由用地单位给予适当的补助费。
第四章 法律责任
第二十七条 用地单位未领取《拆除房屋许可证》,擅自拆除的,属违章拆除行为,所在地国土管理部门可对其处以每平方米五十元的罚款,并责令停止拆除,限期补办手续。
第二十八条 业主或使用人违反本办法第十二条规定,在限定的期间内不自行搬迁的,由所在地国土管理部门对其处以五千元以下的罚款。
第二十九条 用地单位违反本办法规定,擅自提高补偿标准,或在申领《拆除房屋许可证》时报低补高的,由所在地国土管理部门责令其予以纠正。拒不纠正的,收回其土地使用权,由此造成的其他损失均由其自行承担,并由其上级机关对主管人员和直接责任人员作出行政处分。
第三十条 对煽动群众闹事,阻挠拆除房屋的,由公安机关按《中华人民共和国治安管理处罚条例》的规定处理。
第三十一条 国土管理部门和用地单位的工作人员在补偿、安置工作中,利用不正当手段为自己或他人谋取非法利益的,由行政监察部门作出行政处分,情节严重,构成犯罪的,由司法机关依法追究刑事责任。
第三十二条 当事人对区国土管理部门处罚决定不服的,可自接到处罚通知之日起十五日内,向市国土管理部门申请复议;对复议决定不服的,可自接到复议裁决之日起十五日内向人民法院起诉。当事人亦可依法直接向人民法院起诉。
第五章 附 则
第三十三条 本办法实施前已签订拆迁补偿协议的,按原协议执行。
第三十四条 房屋拆迁补偿标准由市国土管理部门制订,报市政府批准后公布实施。
第三十五条 本办法自公布之日起施行,宝安、龙岗两区参照执行。
