广东省加强计划生育管理工作的若干规定
广东省人民政府


规定
为了切实加强计划生育工作的领导,做好各方面的管理工作,保证《广东省计划生育条例》(以下简称《条例》)的贯彻实施,有效地控制广东省人口的增长,实现人口计划目标,特作如下规定:

一、人口目标管理
(一)各级政府要将计划生育工作纳入政府的任期目标责任制,作为考核各级领导政绩的重要内容;省、市、县、镇(乡)政府每年都要召开会议,讨论人口计划生育工作,主要领导要亲自布置和定期检查督促,要分工一名领导负责此项工作。主管部门要协调有关部门齐抓共管,及时
解决计划生育工作中遇到的问题。统计部门每年在公布经济社会发展情况时要分别公布人口计划执行结果和人均经济指标。
(二)层层实行人口计划目标责任制。省长对市长、市长对县(区)长、县(区)长对乡(镇)长,要逐级签订人口计划任期目标责任书,对完成任务好的给予表扬、奖励;对没有完成的要作出检讨,上一级政府应根据情况给予通报批评。连续三年没有完成人口计划控制指标的,应追
究该级政府主要领导及分管领导的责任,并给予相应的处分。
(三)各市、县(区)政府每年在本辖区内进行一次人口抽样调查,核实人口计划执行情况,并逐级组织一次检查评比,按人口计划任期目标责任书的规定兑现奖罚。乡镇以下的检查评比,由县级政府确定。
(四)人口与计划生育的统计,要认真贯彻执行《中华人民共和国统计法》及其《实施细则》,对伪造、篡改、虚报、瞒报统计数字的单位和有关人员,要依法给予行政处分。
(五)各级政府在制订社会、经济、福利、扶贫、教育等政策时,必须有利于计划生育,促进晚婚晚育,少生优生。
(六)各级政府要把计划生育纳入社会主义精神文明建设的重要内容,对违反计划生育的单位和个人不得评为先进。

二、计划生育政策实施管理
(一)各地必须严格执行《广东省计划生育条例》的规定。城镇人口要生二胎的,必须符合“五种人”的条件,从严控制。农村自理口粮到城镇落户的,按城镇人口的生育政策办理。第一个孩子为非遗传性残疾申请生二胎的,必须按照省计生委、卫生厅联合下发的粤计委〔1985〕
064号文关于病残儿的鉴定标准和审批程序的通知,由县以上鉴定小组会诊鉴定,县计生委审批。不按规定审批的,应追究审批人的责任。
农村人口要求生二胎的,要严格执行按计划、有指标、够间隔期(四周岁以上)的规定进行审批。
(二)严禁早婚早育和非婚生育。各级民政部门要认真贯彻《中华人民共和国婚姻法》及其《登记办法》,严格把好婚姻登记关,对未经办理结婚登记而非法同居生育者,按违反婚姻法和超计划生育处理。
(三)民政、司法、公安、计生部门对收养弃婴、领养孩子的,要按规定严格审批;凡未经批准领养者,要查清来源,送回原籍,否则按超计划生育处理;对虚报死婴和把孩子转送他人抚养而瞒报出生的,要给予行政处分或经济处罚。遗弃、溺婴,构成犯罪的,由司法机关依法追究刑
事责任。
(四)孕妇经批准安排生育者,按省计划生育委员会粤计生委〔1988〕06号文《广东省计划生育证管理办法》规定发给计划生育证,凭《生育证》到医院作产前检查及候产。
(五)育龄妇女生了一个孩子的要上节育环,生两个及两个以上孩子的一方要结扎,计划外怀孕要采取补救措施,经医生证明不适宜上环或结扎的,允许采用综合避孕措施。
(六)要落实独生子女的奖励、优待办法。招聘干部、合同制职工、临时工以及租赁或合资企业干部职工的独生子女优待,由所在单位负责;个体户的独生子女优待,按国家计生委、工商行政管理局和劳动协会联合发的〔1987〕国计生委(厅)第字161号文《关于个体工商户计
划生育管理的意见》规定办理;农村的独生子女,在分配或调整责任田、责任山时,可按两人份额分配,超生子女不分责任田和责任山。
(七)超生子女费应按规定征收,建立专门帐目,并接受同级财政部门和上级计划生育部门的检查监督,保证用于计划生育事业,不得挪作他用。
(八)徇私枉法,弄虚作假,伪造骗取、出卖《生育证》、《节育证》及非法取环,破坏计划生育者,要严肃处理。触犯刑律者,提交司法机关依法惩处。

三、流动人口的计划生育管理
(一)各级政府要把流动人口的计划生育作为当地计划生育工作的一个重要部分,加强领导,切实抓好。市、县(区)要成立流动人口计划生育管理领导小组,由计生、公安、工商、财税、人事、劳动、卫生、建委、交通等有关部门组成,政府分工一名领导负责管理,下设办公室。各
镇(乡、街道办事处)也要成立相应的机构,加强管理。所需费用可由各市、县根据流动人口计划生育情况,向外来从业人员收取适量管理费。
各市、县(区)要根据《广东省流动人口计划生育管理办法》的规定,结合当地实际,制定实施办法,明确各部门职责。流动人口的计划生育管理工作,实行条块结合,按人归口,各负其责,层层落实。各机关、团体、企事业单位要管理好本系统、本单位外来人口的计划生育工作。
(二)凡外出从业(包括工业、商业、劳务及个体户等)的已婚育龄妇女,要在当地乡(镇)计划生育办公室登记,并领取全省统一印发的《育龄夫妇生育、节育证》(以下简称节育证),未婚男女青年要领取未婚证明,方能到有关部门办理外出手续。违反计划生育未作处理或未缴清
超生费和未按规定落实节育措施者,不得发给《节育证》,不予办理外出手续。
(三)外来从业人员要持原户籍地的《节育证》或未婚证明,到当地流动人口管理办公室登记验证后方能办理有关手续。凡无《节育证》者,公安部门只准申报暂住登记,不予办理暂住证,工商行政管理部门不发给营业执照,劳动部门不予办理劳务许可证,雇人单位及个体工商业主不
得雇用,房管部门及房主不得给其出售及租借住房,交通监理部门不得发给车辆驾驶证。
(四)对未落实节育措施或计划外怀孕的,用工单位及主管部门要及时向当地计划生育部门报告,并负责动员,限期落实。逾期不落实者,公安部门要取消暂住证,工商行政管理部门要吊销营业执照,交通监理部门要扣留驾驶证,用工单位(或业主)要予以解雇,房屋、土地出租或业
主要收回房屋、土地。放任、包庇者要给予行政处分和经济处罚。
(五)流动人口落实节育措施的手术费用,由用工单位负责,无用工单位人员和个体户,由当地政府在收取外来从业人员管理费及征收超生子女费中统筹解决。

四、宣传教育工作的管理
(一)计划生育是一项基本国策,各级新闻、广播电视、文化、教育、卫生、民政、工、青、妇等有关部门要制订经常性开展《婚姻法》和计划生育宣传活动计划,特别是元旦、春节期间要开展计划生育宣传月活动。
(二)要加强人口和计划生育形势、政策的宣传。报纸、电台、电视台每周要安排专门版面和时间,刊登或播放有关人口与计划生育内容的报导。
(三)各级干校和各大专院校,要把人口与计划生育有关政策和知识,列为培训干部和教育大专学生的一项内容;中学要开设青春期卫生和人口知识课。
(四)要在群众中普遍进行人口与计划生育基础知识教育,宣传男女平等,树立新的婚育观念;准备结婚的青年男女,必须在所在乡镇(街道)接受婚前教育。

五、计划生育技术管理
(一)各级计划生育部门和卫生部门要加强计划生育技术管理。凡从事计划生育技术工作的人员,必须经过专业培训、考核,取得合格证书后,方可开展节育手术,无合格证书者,不准做节育手术。
(二)计划生育手术工作人员,要严格执行《节育手术常规》,做到手术质量第一,安全第一,任何单位和个人,不得强迫计划生育技术人员对不适宜接受节育手术的人施行手术,以确保受术者的健康和安全。
(三)严禁个体行医人员从事节育手术工作。
(四)卫生医疗部门要严格执行省卫生、财政、物价、计生部门联合规定的手术收费标准,未经省统一调整,不得擅自提高手术费标准和增加收费项目。
(五)乡(镇)医院、卫生院和计划生育服务站节育手术室,要符合农村基层简易手术室的基本要求,不符合的,不准开展节育手术工作。
(六)市、县(区)设节育手术并发症鉴定领导小组,由计划生育、卫生部门的领导和医疗技术人员组成负责专门处理并发症鉴定工作中发生的问题,经技术鉴定组确认的,由县计划生育委员会发给并发症卡,到指定医疗单位进行治疗。县技术鉴定小组意见不统一或本人对鉴定不服者
,应逐级上报解决。

六、计划生育机构与队伍的管理
(一)各级计划生育委员会,是该级政府管理计划生育工作的职能部门,各级政府应根据计划生育工作的需要配齐干部,加强培训,提高素质,确保有一支精干得力的队伍去抓好计划生育工作。
(二)各级计生委要健全委员制。农委、计委、统计、财政、公安、民政、卫生、工商行政管理、人事、监察、劳动、广播电视和工、青、妇等有关部门要有一名负责人兼计生委员,研究计划生育工作的重要问题,协调各方面关系,共同做好计划生育工作。
(三)乡(镇)设计划生育办公室,为同级政府管理计划生育的职能单位,办公室设主任和专职干部若干人,三万人以下的乡(镇)配两至三人,三万人以上的乡(镇)要适当增加。乡(镇)下设的管理区设计划生育领导小组,配备一至二名干部专管计划生育工作,列入管理区的干部
编制。自然村由村干部负责,可不设专职人员。城市街道办事处和大中型厂矿也要设立计划生育机构和配备专职干部。乡(镇)、村(管理区)和街道、厂矿计划生育干部的福利待遇,应与乡(镇)、村、街道、厂矿其他干部相同。
(四)市、县计划生育服务站为同级计生部门的事业单位,要根据当地人口多少和工作需要,实行定人员、定经费、定任务。人员编制和经费由市、县政府统筹解决。服务站的医疗技术人员要同卫生部门一样评定职称。乡(镇)一级计生服务站、所,也要分期分批建立起来。
(五)计划生育协会是当地开展计划生育工作的群众组织,其主要任务是宣传计划生育方针政策,动员干部群众实行计划生育和落实节育措施。当地政府与计划生育部门要帮助和支持协会的工作。
(六)各级从事计划生育专职工作人员实行岗位津贴,离开计生岗位则自然取消。其标准由各级计生委请示同级政府决定。经国家计生委核准并发给计划生育工作荣誉证书的计划生育工作人员,由本人所在单位发给相当于本人两个月基本工资的一次性奖励,受到省委、省政府以上表彰
的计划生育先进工作者,退休后加发本人工资百分之五至百分之十的退休金,连同退休费,最高额不能超过本人基本工资的百分之一百。具体实施办法由人事、财政、劳动、计生部门共同拟定。
(七)各级原包干的计划生育事业费,要根据各地财政收入和物价变化情况,认真安排,逐年增加。
本规定自1989年9月1日起施行。

  nterpretation
  his Ordinance, unless the context otherwise requires--

 PART II PROTECTION OF WAGES ON INSOLVENCY FUND BOARD
  
  stablishment and incorporation of Wages on Insolvency Fund Board
  There is hereby established a board to be known as the Protection 
of
  s on Insolvency Fund Board and in the Chinese language as which 
shall
  body corporate.
  The Board shall consist of a Chairman appointed under the Schedule
and
  more than 10 members appointed by the Governor as follows--
  subject to paragraph (b) not more than 4 public officers;
  equal numbers of persons who, in his opinion, represent employers 
and
  ons who, in his opinion, represent employees.
  The Governor shall give notice of each appointment by notice in 
the
  tte.
  The Schedule shall have effect with respect to the Board.
  unctions and powers of the Board
  The Board shall have the following functions--
  to administer the Fund;
  to make recommendations to the Governor with respect to the 
rate of
  ; and
  to perform such other duties as are imposed or other powers as 
are
  erred on it by this Ordinance.
  The Board may do all such things as are necessary for, or 
incidental
  onducive to, the better carrying out of the functions of the Board
and
  in particular, but without prejudice to the generality 
of the
  going--
  hold, acquire or lease all kinds of property whether 
movable or
  vable;
  sell or otherwise dispose of all kinds of property whether movable 
or
  vable;
  subject to section 10, invest its funds in such manner and to 
such
  nt as it thinks necessary or expedient; and
  with the prior consent of the Financial Secretary, borrow 
money in
  manner and on such securities or terms as it thinks expedient.

 PART III FUND

  payments to applicants under section 16;
  expenses incurred by the Board for the purposes of this Ordinance;
  capital, interest and charges in respect of any loan; and
  any other sums required or permitted to be paid by the Fund under
this
  nance.
 PART IV FINANCIAL PROVISIONS
  
  inancial year and estimates
  The Board may, from time to time, with the prior approval 
of the
  rnor, fix a period to be the financial year of the Fund.
  In each financial year, before a date to be fixed by the Governor,
the
  d shall submit to the Governor, for his approval, estimates 
of the
  me and expenditure of the Fund for the next financial year:
  ided that the estimates for the first financial year of the Fund
shall
  ubmitted as soon as practicable after the commencement 
of this
  nance.
  The Governor shall consider the estimates submitted to 
him under
  ection (2) and may approve or reject them and, in the 
case of
  ction, may require the Board to resubmit the estimates 
modified in
  manner and within such time as the Governor may direct.
  The Board may, from time to time, vary the estimates approved 
under
  ection (3) and shall, as soon as practicable, deliver to the 
Governor
  atement in writing containing details of any variation.
  ank account
  Board shall open and maintain an account with a bank approved by 
the
  ncial Secretary and shall pay all moneys of the Fund 
into that
  unt.
  Investment of moneys
  moneys of the Fund that are not immediately required by the Board 
may
  
  deposited on fixed term or call deposit or in a savings account
in
  bank licensed under the Banking Ordinance (Cap. 155); or
  with the prior approval of the Financial Secretary, invested in 
such
  r investments as the Board thinks fit.
  Accounts
  Board shall--
  keep and maintain such accounts and records of all transactions
of the
  as the Director of Accounting Services may require; and
  after the end of each financial year cause to be prepared a 
statement
  he accounts of the Fund which shall include an income and 
expenditure
  unt and balance sheet and shall be signed by the Chairman.
  Auditors
  The Board shall at the commencement of each financial year 
appoint
  tors, who shall be entitled to have access to all books of 
account,
  hers and other records kept by the Board and to 
require such
  rmation and explanations as they may think fit.
  The auditors shall audit the statement of accounts prepared 
under
  ion 11 and shall report thereon to the Board.
  Statements and reports to be laid on table of Legislative Council
  The Board shall, within 6 months after the end of each financial 
year
  uch further time as the Governor may for any particular year 
allow,
  it to the Governor a report on the activities of the Board for 
that

  The Governor shall cause the reports and statements received 
by him

  Costs of administering the Fund
  All costs and expenses incurred by the Government in
administering the
  shall be a charge upon general revenue.
  The Financial Secretary may direct that a supervision fee 
to be
  rmined by him, in relation to such period as may be determined
by him,
  l be charged against the income of the Fund and shall at a 
time
  rmined by him be paid to him by the Board from the Fund and paid 
by
  into general revenue.
 PART V PAYMENT FROM THE FUND
  
  Entitlement to apply for ex gratia payment
  Subject to this Part, an applicant to whom--
  wages are due and unpaid;
  wages in lieu of notice are due and unpaid; or
  the liability to be paid a severance payment has arisen 
and the
  rance payment is unpaid, whether or not the severance payment is 
then
  may apply for an ex gratia payment from the Fund in respect of 
the
  s, wages in lieu of notice or the severance payment, as the case 
may
  or all or any of them. (Replaced 38 of 1989 s. 3)
  An application under subsection (1) (in this Part called an
  lication" ) shall be made to the Commissioner in writing in a 
form

  No applicant shall apply for payment from the Fund in respect of 
any
  s for services rendered before 1 April 1985.
  No applicant shall apply for payment from the Fund in respect of

  ieu of notice arising out of a contract of employment

  Payment
  Subject to subsections (1B) and (2) where it appears 
to the
  issioner that an employer has failed to pay any wages, wages in 
lieu
  otice or severance payment, as the case may be, or all or any of 
them
  n applicant and that--
  in the case of an employer who is not a company--
  a bankruptcy petition has been presented against him; or
  he has committed an act of bankruptcy within the meaning of
section 3
  he Bankruptcy Ordinance (Cap. 6) but a petition cannot be 
presented
  nst him by reason of section 6 (1) (a) of that Ordinance; or

  Where an application has been made in respect of a severance 
payment

Commissioner may

  The Commissioner shall not make any payment under subsection
(1)--
  to the applicant unless the applicant has verified his
application by
  atutory declaration in a form approved by the Commissioner;

  in respect of wages for services rendered more than 4 months prior

  Review by Board
  Any applicant aggrieved by any decision of the Commissioner 
under
  ion 16 may in writing--
  request the Commissioner to give reasons for that decision; and
  after being given reasons under paragraph  (a), 
request  the

  Upon receiving a request from an applicant under subsection (1) 
(b),

第一章 总 则
第一条 为妥善处理城市建设中房屋拆迁补偿安置问题,保障城市建设顺利进行,根据国家有关法律、法规和国务院《城市房屋拆迁管理条例》,结合深圳经济特区实际情况,制定本办法。
第二条 凡市、区国土管理部门(以下统称国土管理部门)因征用土地、收回土地或其他用地单位征用土地,涉及拆除土地上的房屋而引起的拆迁、补偿、安置事宜的,适用本办法。
第三条 深圳市规划国土局(以下简称市规划国土局)对全市的房屋拆迁工作进行管理、协调和监督。
区国土管理部门负责组织实施本辖区范围内的房屋拆迁工作,接受市国土局的业务指导和监督。
第四条 国土管理部门拆除被收回、被征用土地上的房屋时应遵循在城市规划的指导下,统筹安排、依法进行、合理补偿、妥善安置的原则。
第五条 任何单位和个人必须服从国家建设需要,不得妨碍和阻挠征用拆迁工作的进行。
第六条 拆迁补偿应协商解决,协商不能解决的,由国土管理部门依法作出征用或收回土地补偿安置处理决定。自决定书发出之日起,土地的权属转为国有或被收回。

第二章 拆除管理
第七条 拆除房屋应经国土管理部门批准并领取《拆除房屋许可证》。未经批准许可的,任何单位或个人均不得擅自拆除房屋。
第八条 属国土管理部门征用或收回土地的,由所在地的区国土管理部门将实施方案报市规划国土局,由市规划国土局同意后发给《拆除房屋许可证》。区国土管理部门领取《拆除房屋许可证》后向业主发出拆除房屋通知书。
南油、蛇口、华侨城、盐田港、沙头角保税区、福田保税区规划范围内的房屋拆除,由用地单位向所在区的国土管理部门领取《拆除房屋许可证》并自行组织实施。必要时,国土管理部门也可以将特殊用地范围内的房屋拆除,指定使用该宗土地的单位或其他单位组织实施。
第九条 由用地单位组织实施拆除工作的,用地单位应提交下列文件、资料,向所在区国土管理部门申领《拆除房屋许可证》。
(一)拟拆除房屋的业主姓名、家庭人口及产权部门提供的产权资料;
(二)拟拆除房屋所在地段、面积、结构、用途及价值;
(三)拟补偿安置方案,包括:补偿金额、安置面积、地点和临时安置计划。
第十条 经区国土管理部门审查,认为用地单位提供的资料真实、补偿方案合理、安置措施妥善的,发给《拆除房屋许可证》,并向业主发出拆除房屋通告书。国土管理部门应将有关拆除事项在《深圳特区报》公告或以其它形式予以公布。
第十一条 业主应自接到拆除房屋通知书之日起三个月内与区国土管理部门或用地单位进行协商,并签订补偿安置协议。法律、法规有特殊规定的,按规定执行。
有关补偿应按本办法和本办法附件规定的标准执行。没有规定标准的,由国土管理部门委托市物业估价所进行评估。本办法附件规定标准的调整,由市建设主管部门公布。
第十二条 协商期限届满后仍不能达成协议的,由区国土管理部门作出征用或收回土地补偿安置处理决定,自处理决定发出之日起,土地原属农村集体所有的,被征为国有;土地使用权原属单位或个人拥有的,被政府收回。业主对补偿安置有异议的,可在接到处理决定书之日起三十日
内向所在区人民法院起诉。诉讼期间不停止拆迁的执行。
业主或使用人必须在处理决定限定期间内自行搬迁。期限届满仍未搬迁的,由市、区人民政府责令有关部门强制拆迁,或由所在地国土管理部门向人民法院申请强制执行。
业主不起诉,在规定期限内又不来领取补偿费的,该补偿费由国土管理部门无息保管。
业主在规定期限内不来认领房屋产权的,该房屋由房管部门代管。
第十三条 业主自接到国土管理部门拆除房屋通知之日起,不得为下列行为:
(一)对被通知拆除的房屋进行改建、扩建和装修;
(二)对被通知拆除的房屋进行买卖、交换、抵押;
(三)对被通知拆除的房屋设立或变更租赁关系。
第十四条 被通知拆除的房屋所在地的居民委员会或村民委员会、公安机关以及业主所在单位,有责任协助、配合国土管理部门和用地单位做好拆迁工作。
第十五条 国土管理部门应当建立、健全拆迁档案制度,加强对拆迁档案资料的管理。

第三章 补偿和安置
第十六条 拆除房屋,根据不同情况进行补偿:
(一)拆除属于城市居民的房屋,补偿同等面积的房屋,但经业主同意,也可以现金补偿。如该地属有偿受让用地(即由市区国土局有偿出让用地,下同)补偿双方必须对地价的差价进行结算。
(二)农村村民在农村用地规划范围内已安排有宅基地的,对其被征用的旧居屋,只给予补偿现金,不再划地,也不再补偿房屋。
(三)拆除华侨和港、澳、台同胞本人在农村的旧屋,可以房屋进行补偿,经业主同意也可以现金补偿。业主在农村规划用地范围内已安排有宅基地的,以现金进行补偿。
(四)拆除单位(含集体、国营企事业单位、机关、团体,中外合资、合作企业,外资企业等)房屋,以同等结构、同等面积进行补偿;该用地属有偿受让的,补偿双方必须就地价(现值)的差价进行结算。经补偿双方商定,也可以换地的方式进行安置。
按本条规定用房屋进行补偿的,以统建形式进行安置,补偿双方应对面积、结构、质量的差异进行差价结算,并在协议中订明。
协商期限届满仍不能达成协议,由区国土管理部门作出处理决定的,对房屋拆迁安置补偿,一般以现金进行补偿。
第十七条 拆迁补偿实行产权调换的,如补回的房屋与原房屋质量或面积相差校大的,补偿双方应进行质量、面积的差价结算。补偿的面积大于被拆房屋面积的,超出部分按微利商品房价格由业主补偿给用地单位。
第十八条 被征用土地拟建房屋与被拆除房屋的用途相同的,业主应当获得就地安置。
第十九条 因公产住房被拆除而受影响的使用人,由市住宅局按有关房管规定给予安置。
第二十条 拆除经批准的临时用地的房屋,原临时用地合同自动终止。合同存续期仍有一年以上的,应对房屋作适当的补偿,但临时用地合同另有规定的,按合同规定办理。
第二十一条 对应当补偿房屋而暂时又无法补偿的,应对受影响的业主和使用人妥善、合理地给予安置临时居所,由此产生的费用由用地单位支付。
第二十二条 因动迁而产生的搬迁费用,由用地单位按实际支出支付给业主或使用人。
业主和使用人所在单位应给予必要的搬迁时间。搬迁期间的工资应予照发。
第二十三条 被拆除房屋原有租赁关系,被拆除后又补偿房屋的,租赁合同继续生效,租赁双方可对有关权利义务进行协商变更;用现金补偿的,租赁合同自动终止。
第二十四条 拆除有产权纠纷房屋,在拆除房屋协商补偿期限内纠纷未解决的,拆迁前,国土管理部门应当组织拆迁人及邀请市物业估价所对将被拆除的房屋作勘察纪录,并向公证机关办理证据保全。
第二十五条 被拆除房屋属下列情况之一的,不予补偿:
(一)违章建筑的房屋;
(二)违法占地上的房屋;
(三)违反土地使用合同,被市国土局收回土地使用权,被收回的土地上的房屋;
(四)违反本办法第十三条第(一)项规定的改建、扩建和装修部分;
(五)土地使用年期届满的房屋。
第二十六条 拆除非住宅房屋造成停产、停业引起经济损失的,由用地单位给予适当的补助费。

第四章 法律责任
第二十七条 用地单位未领取《拆除房屋许可证》,擅自拆除的,属违章拆除行为,所在地国土管理部门可对其处以每平方米五十元的罚款,并责令停止拆除,限期补办手续。
第二十八条 业主或使用人违反本办法第十二条规定,在限定的期间内不自行搬迁的,由所在地国土管理部门对其处以五千元以下的罚款。
第二十九条 用地单位违反本办法规定,擅自提高补偿标准,或在申领《拆除房屋许可证》时报低补高的,由所在地国土管理部门责令其予以纠正。拒不纠正的,收回其土地使用权,由此造成的其他损失均由其自行承担,并由其上级机关对主管人员和直接责任人员作出行政处分。
第三十条 对煽动群众闹事,阻挠拆除房屋的,由公安机关按《中华人民共和国治安管理处罚条例》的规定处理。
第三十一条 国土管理部门和用地单位的工作人员在补偿、安置工作中,利用不正当手段为自己或他人谋取非法利益的,由行政监察部门作出行政处分,情节严重,构成犯罪的,由司法机关依法追究刑事责任。
第三十二条 当事人对区国土管理部门处罚决定不服的,可自接到处罚通知之日起十五日内,向市国土管理部门申请复议;对复议决定不服的,可自接到复议裁决之日起十五日内向人民法院起诉。当事人亦可依法直接向人民法院起诉。

第五章 附 则
第三十三条 本办法实施前已签订拆迁补偿协议的,按原协议执行。
第三十四条 房屋拆迁补偿标准由市国土管理部门制订,报市政府批准后公布实施。
第三十五条 本办法自公布之日起施行,宝安、龙岗两区参照执行。
